The Impact of the Annulled Privacy Shield
Your company’s data could be at risk. If you are using a US-based VDR you might be in breach of EU/Swiss data protection requirements, and in particular the General Data Protection Regulation (GDPR).
How can you be sure your data is secure in your chosen VDR? And what should you do about it? In this report we talk about the axe of the EU-US Privacy Shield and how using the wrong VDR could mean present your business problems in the future.
What are the Privacy Shield Frameworks?
Both the EU-US and Swiss-US frameworks were introduced by the US Department of Commerce, the European Commission, and the Swiss Administration. They were designed to help companies in these territories transfer personal data between them, while still complying with all data protection requirements.
However, this way of working was criticised in July 2020. The European Court of Justice said that this framework did not protect the data of European citizens from US surveillance activities.
The court found that US law does not ensure the level of protection required by the EU’s General Data Protection Regulation (GDPR).
In this report we detail the data privacy ruling and how it presents problems for unaware data room users. We also explain the key issues you should be looking to investigate and possibly correct.
